Terms & Conditions

Introduction

These are the terms and conditions of We Buy Any Diamonds, WBAD, PO Box 558, Burnley, Lancashire. BB11 9GJ, and apply to all business transactions undertaken between the Company and its customers.

By sending diamonds and associated properties to We Buy Any Diamonds, all customers agree to accept these terms and conditions.

General

To sell to We Buy Any Diamonds, the customer must be the legal owner of the diamonds and any associated property involved in the transaction; be over 18 years of age; not be acting as a third party agent in the transaction. We Buy Any Diamonds reserve the right to decline to continue with a transaction if, when reasonably requested, proof of ownership cannot be demonstrated.

The customer indemnifies We Buy Any Diamonds against any actions arising from any illegal activity associated with the property and guarantees that such property is not the result of illegal activity.

All customers must complete and sign the Customer Declaration form when sending diamonds to We Buy Any Diamonds.

We Buy Any Diamonds is an ethical business and will not trade in unethical diamonds (blood or war diamonds).

We Buy Any Diamonds does not sell diamonds to the public. Diamonds purchased are recycled through the diamond trade;

Postage & Insurance

We Buy Any Diamonds use Royal Mail Special Delivery as its primary delivery services provider and supply a postage-paid package for the customer to use in sending diamonds for valuation. It is the customer’s responsibility to ensure that the property sent is securely packed and sealed within the package and a postage receipt and tracking reference are retained.

The contents of the package are insured up to the maximum cover as provided by the Royal Mail Special Delivery terms and conditions. Where this is not appropriate for the value of the diamonds to be sent, We Buy Any Diamonds will make separate arrangements with the customer for handling and insurance.

Claims for damage or loss of goods in transit between the customer and We Buy Any Diamonds must be made through the Royal Mail Special Delivery claims procedures. Customer’s diamonds and associated property will be appropriately insured whilst in the care of We Buy Any Diamonds and any claim for damage or loss will be handled by the company insurer’s claims procedures.

All packages are opened and contents checked and confirmed. We Buy Any Diamonds reserve the right to reject any packages which arrive in a damaged, opened or tampered state or where the Customer Declaration form has not been correctly completed and signed.

Valuation and Offer

Valuation is undertaken by the We Buy Any Diamonds professional diamond experts and is based on market prices in force at the time of the valuation. Due to the constantly changing market for diamonds and precious metals, each valuation is valid for acceptance for a period of 48 hours.

Where diamonds are set into jewellery, it may be necessary to remove the diamond to achieve a true valuation. We Buy Any Diamonds will always contact the customer prior to removing diamonds to explain the procedure and obtain consent.

Once you have accepted our offer, the goods can be immediately shipped for diamond removal and melting down so your acceptance is legally binding on both of us and it is irrevocable. Please note that when accepting an offer, any no value items will not be automatically returned unless specifically requested at the time of the offer.

If the We Buy Any Diamonds offer is not acceptable, the diamonds and associated properties will be packaged and returned free of charge to the customer by Royal Mail Special Delivery under the same terms as described above.

Following acceptance of an offer, We Buy Any Diamonds will grant the customer a 7-day period during which time the customer may buy the diamonds back from We Buy Any Diamonds should the customer have a change of mind regarding the sale.

Payment Terms

We Buy Any Diamonds will arrange payment in full of the agreed purchase price within 24 hours of the customer accepting the offer. This is subject to our normal hours of business which are between 09.30 and 17.00, Monday to Friday only.

Payment will be made by bank transfer directly into the customer’s bank account with confirmation of the payment provided.

Returned Items and Unidentified Property

Under the terms of the Royal Mail Special Delivery service, packages will not be left without signature. Where this is not achieved in respect of diamonds returned following a declined offer, and the Royal Mail re-delivery procedure is exhausted without successful signed acceptance, the package will be returned to We Buy Any Diamonds who will attempt to make arrangements for further delivery.

Such additional arrangements will be charged to the customer with payment due within 21 days of request for payment. Where such payment is not received, We Buy Any Diamonds reserve the right to purchase the diamonds at the offer price less incurred costs and thus finalise the transaction.

It is the customer’s responsibility to ensure that full identification is provided when sending items to We Buy Any Diamonds by completing the Customer Declaration form and including it within their submission.

Where this is not done, We Buy Any Diamonds will make every effort to trace the identity of the sender, but reserves the right to dispose of the items should the owner not be traced within 6 months.

It should be noted that the We Buy Any Diamonds Special Delivery package should only be used for sending items to the company. All such packages are delivered to We Buy Any Diamonds regardless and any items received by We Buy Any Diamonds resulting from incorrect use of the service will be held subject to a release payment of £20.00 to be paid by the customer.

Legal Information

Webuyanydiamonds is a trading name of Antwerp Diamonds Ltd. Company registration 05155772. The laws of the United Kingdom (and English law in particular) are taken as the basis for this agreement. We Buy Any Diamonds and the customer submit to the non-exclusive jurisdiction of the English courts, unless the customer is living in Scotland, Northern Ireland, the Channel Islands or the Isle of Man, in which case the customer will be entitled to commence legal proceedings in their local courts. If any part of this Service Agreement that is not fundamental is found to be illegal or unenforceable, such finding will not affect the validity or enforceability of the remainder of the Service Agreement.

Failure by We Buy Any Diamonds to exercise or enforce any right or provision of these terms & conditions will not be deemed to be a waiver of such right or provision. Customers agree that any claim or cause of action arising from use of the services offered by We Buy Any Diamonds must be filed within one year after such claim or cause of action arose. Any such claim or cause of action must be filed in the UK.

The customer agrees to indemnify We Buy Any Diamonds against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach by the customer of these terms & conditions, including claims brought by third parties.

We Buy Any Diamonds reserves the right to change these terms & conditions.

We Buy Any Diamonds complies with all requirements of the Data Protection Act. Customer information will only be used with the prior permission of the customer.
